Sabato 27 giugno alle 10.30 di mattina il server internet di Isole Nella Rete, l'associazione no-profit che fornisce spazio e comunicazione a centri sociali, organizzazioni e radio di movimento, associazioni di base e di volontariato sociale, è stato posto sotto sequestro dalla Polizia Postale di Bologna. Da oggi quindi, e non sappiamo per quanto tempo ancora, il server non risponderà più all'indirizzo http://www.ecn.org, non saranno più visibili le pagine web, né potranno essere disponibili i servizi di posta elettronica che hanno permesso in questi anni di costruire una fitta rete di solidarietà fra vasti settori del movimento e dell'autorganizzazione.

Il sequestro è avvenuto nei locali del provider che ospitava il server, su ordine del Pubblico Ministero della Procura di Vicenza Paolo Pecori ed è stato eseguito dagli ufficiali di Polizia Postale del Compartimento di Bologna.

Si tratta di un sequestro preventivo ipotizzante il reato di diffamazione continuata ai danni di una agenzia di viaggi. Motivo del sequestro sarebbe la pubblicazione web di un messaggio inserito da un collettivo di Vicenza, fedele trascrizione di un volantino stampato su carta e normalmente distribuito in pubblico. Questo messaggio è stato originariamente inviato a una lista di discussione (cslist) ospitata dal server di Isole Nella Rete e successivamente - in modo automatico come normalmente avviene - pubblicato sul web.

Sebbene il decreto di sequestro non citi espressamente ancora nessuna persona formalmente indagata, il magistrato ha evidentemente ritenuto l'associazione Isole Nella Rete responsabile per il contenuto di quanto ospitato sul proprio server Internet. La questione della responsabilità dei provider è in realtà materia di discussione accesissima in tutto il mondo e ben lontana dall'essere risolta. L'orientamento prevalente sembra tuttavia essere quello di NON considerare i provider responsabili dei contenuti che veicolano, se non altro per ragioni di possibilità tecniche e di convenienza commerciale.

L'ordine di sequestro dell'intero server, inoltre, appare assolutamente inaudito poiché riguarda un servizio utilizzato da migliaia di utenti italiani e di ogni parte del mondo, del tutto estranei alla vicenda che ha portato a ipotizzare il reato di diffamazione, e che si vedono improvvisamente privati di un mezzo di comunicazione indispensabile.

Stiamo cercando di analizzare la situazione per trovare le migliori soluzioni a quello che ci sembra un caso gravissimo e che avrà, comunque vada a finire, un'altissima risonanza.

Informiamo che il server web www.ecn.org, tutte le mailing e tutti gli indirizzi di posta elettronica ivi ospitati sono attualmente fuori servizio. Stiamo lavorando per ripristinare un server di backup al più presto possibile.

Saturday, June 27th at 10:30 am the server of Islands in the Net (Isolenella Rete, an Italian non-profit association that offers communication spaces to social centres, free radios and collectives of the movement) has been seized by the Postal Police in Bologna for allegedly defamatory material posted on its system.

Starting from now, and who knows for how long, the server at http://www.ecn.org is down, its web pages are no longer available online and all its e-mail services that permitted in the last years the construction of a strong solidarity network among several self-organized collectives are shut down. The seizure took place in the office of the Internet provider hosting the server, ordered by the State Prosecutor of Vicenza Paolo Pecori and was executed by officers of the Postal Police of Bologna.

It is a 'preventive' seizure, claiming the crime of 'prolonged defamation' toward a travel agency in Milan. The reason for the seizure would be the web publication of a message posted by an Italian collective, accurate transcription of a printed flyer publicly distributed. This message was first sent to a mailing list (cslist) hosted by the server of Islands in the Net and then published on the web through the usual automatic procedure.

The flyer (and the message posted on the mailing list and on the web aswell) claimed that Turban Italia Srl, a travel agency in Milan, had strong financial ties to former Turkish Prime Minister Tansu Ciller, then suggesting a boycott of the agency services in solidarity with Kurdistan people persecuted by Turkish government.

Although the seizure order still does not explicitly mention any person formally charged with the crime of defamation, the judge that ordered this action evidently holds Islands in the Net liable for the content of anything hosted by its Internet server. The liability of the providers for the contents they carry is actually a very hot topic worldwide still far from a viable solution.

However, the main direction is that Internet providers should NOT beinghold liable for the contents they carry, at least on grounds both of technical feasibility and commercial suitability.

The order of seizure of the server (and its entire content), furthermore,seems exceptionally harmful because it hits a service used by hundreds of users in Italy and abroad, completely unaware of the events that conducted to the charge. Now those users are suddenly deprived of their communication tool, without any notice or explanation. Their rights have been clearly violated.

We are currently closely studying the situation in order to find the bestsolutions to what seems to us an extremely serious event that will, in any case, be known far and wide.

For now the web server at www.ecn.org, all the mailing lists and all thee-mail addresses hosted by the server are down. We are working to set up a backup server as soon as possible.

Am Samstag, den 27 Juni um 10:30 Morgens ist der Web-Server von "Isole Nella Rete" -- "Inseln im Netz" --, ein nicht-kommerzieller Verein der sozialen Zentren, linken Organisationen und Szene-Radios Raum und Kommunikationsmittel im Netz zur Verfügung stellt, von der Polizei in Bologna (Italien) beschlagnahmt worden. Folglich antwortet der Server unter der URL http://www.ecn.org/ seit heute -- und wir wissen nicht, wie lange noch -- nicht mehr auf Anfragen; die Webseiten sind nicht mehr Abrufbar und und die Email-Dienste stehen ebenfalls nicht mehr zur Verfügung; Dienste, dank derer in den letzten Jahren ein Dichtes Netz der Solidarität zwischen vielen Bereichen der Bewegung und selbstverwalteten Orten geschaffen werden konnte. Die Beschlagnahmung fand in den Räumlichkeiten des Providers statt, wo der Server stand.

Der Befehl wurde vom Staatsanwalt der Landesstaatsanwaltschaft inVicenza, Paolo Pecori, unterzeichnet und wurde von der Polizei aus Bologna ausgeführt.

Es handelt sich um eine Präventivbeschalgnahmung aufgrund einer angeblichen andauernden "üblen Nachrede" gegen ein Reisebüro. Der Grund für die Beschlagnahmung sei die Veröffentlichung einer Nachricht im Web, die ein Kollektiv aus Vicenza geschrieben hat -- eine Abschrift von einem auf Papier gedrucktem Flugblatt das öffentlich verteilt wurde. Diese Nachricht ist Ursprünglich an eine Diskussionsliste geschickt worden (cslist), die auf dem Server "Isole Nella Rete" leuft, und anschließend -- automatisch -- im Web veröffentlicht worden.

Obwohl der Beschlagnahmebefehl keine Personen benennt, gegen dieoffiziell ermittelt wird, hat der Staatsanwalt offensichtlich den Verein "Isole Nella Rete" für die Inhalte auf dem eigenen Web-Server für verantwortlich gehalten. Die Frage der Verantwortung des Providers ist in der Tat Gegenstand hitziger Diskussionen überall auf der Welt, die noch weit davon entfernt ist, eine Lösung zu finden. Die überwiegende Meinung scheint jedenfalls die zu sein, daß die Provider NICHT für die transportierten Inhalte verantwortlich sind, nur für die technischen Möglichkeiten und die kommerziellen Aspekte.

Außerdem ist die Beschlagnahmung des gesamten Servers völlig unangebracht, da dies einen Dienst betrifft den tausende von UserInnen aus Italien und anderen Teilen der Welt benutzen, die mit der Angelegenheit nichts zu tun haben die die Straftat der "üblen Nachrede" erfüllt haben soll, und denen plötzlich ein notwendiges Kommunikationsmittel genommen wurde.

Wir sind dabei, die Situation zu analysieren um die bestmöglichen Lösungen für diesen schwerwiegenden Fall zu finden, der, wie es auch
immer enden wird, eine hohe Resonanz haben wird.

Wir informieren Euch, das der Server www.ecn.org, alle Mailinglisten und alle Emailadressen, die darüber laufen, zur Zeit nicht erreichbar sind. Wir sind dabei einen Backupserver zusammenzustellen der so schnell wie möglich ans Netz gehen wird.

Samedi 27 juin à 10h30 le serveur internet Isole Nella Rete, l'association non-commerciale qui fournit de l'espace et des moyens de communication aux centres sociaux, organisations et radios de mouvement, aux associations de base et de bénévolat social, à été mis sous séquestration par la Police postale de Bologne.

A ce jour, et nous ne savons pas pour combien de temps, le serveur ne répondra plus à l'adresse http://www.ecn.org , les pages pages web ne seront plus disponibles et les services de courrier électronique qui ont permis ces dernières années de construire un important réseau de solidarité entre de large secteurs du mouvement et de l'auto-organisation.

La séquestration a eu lieu dans les locaux du fournisseur d'accès quihébergeait le serveur, sur ordre du juge Paolo Pecori du Parquet de Vicenza et éxécutée par la Police postale de Bologne. Il s'agit d'une mise sous scélés préventifs, motivée par un délit de "diffamation continue" envers une agence de voyage. Le motif en étant la publication sur le web d'un message mis en circulation par un collectif de Vicenza, transcription fidèle d'un tract imprimé et distribué. Ce message avait d'abord été envoyé sur une liste de discussion (cslist) hébergée par le serveur Isole Nella Rete et ensuite, puis ensuite publiée sur le web suivant la procédure automatisée normale.

Le tract (et par voie de conséquences le message posté sur la liste etpublié sur le web) affirmait que Turban Italia srl, une agence de voyage de Milan, a des liens financiers importants avec l'ancien Premier ministre de Turquie Tansu Ciller, et proposait un boycott de cette agence en solidarité avec le peuple kurde presécuté par le gouvernement turc.

Bien que le mandat de séquestration ne mentionne encore nominalement aucune personne inculpée dans cette affaire, le magistrat a retenu l'association Isole Nella Rete comme responsable pour le contenu de ce qui est hébergé sur son serveur internet. La question de la responsabilité des providers quant au contenu des informations qu'ils véhiculent est une question vivement débatue dans le monde entier, et encore loin d'être résolue.

Cependant, l'orientation qui semble se dégager est de NE PAS considérer les providers comme responsables des contenus qu'ils véhiculent, tant pour des raison de possibilités techniques de contrôles que de convenance commerciale.

La décision de séquestration de la totalité de ce serveur (et de la totalité de son contenu), en outre, apparait absoluement inoui dans la mesure où il s'agit d'un service utilisé par des milliers d'usager en Italie et dans le reste du monde, totalement étrangers aux faits qui ont conduit à cette procédure pour délit de diffamation, et qui se trouvent ainsi privés d'un moyen de communication indispensable.

Nous cherchons actuellement à analyser la situation pour trouver les meilleurs solutions à ce qui nous semble une affaire extrêmement grave et qui, de toute les façons, aura un retentissement important.

Nous informons que le serveur web www.ecn.org, toutes la mailing lists et toutes les adresses e-mail hébergés sont actuellement hors-service. Nous travaillons pour mettre en fonction un serveur de sauvegarde le plus rapidement possible.

Secuestrado!

Sabado 27 de Junio de 1998 a las 10:30 de la mañana "Isole nella Rete (INR)" el servidor de la ECN ha sido clausurado y secuestrado por la policía postal de Bolonia, por contener material difamatorio en su sistema.

"Isole nella Rete" (islas en la red) es un servidor sin animo de lucro, fundado en Milan en 1996 y cuenta actualmente con 300 mienbros, ofrece espacio web y toda serie de servicios en Internet (NT: conectividad no) a mas de 100 grupos (centro sociales, radios libres, asociaciones culturales y otras entidades involucradas en politica, solidaridad y actividades sociales en Italia y Europa.

Sin previo aviso, el sábado por la mañana tod@s l@s usuari@s encontraron su servidor no operativo y sus mensajes perdidos. El web site www.ecn.org inutilizable y en silencio, posiblemente por meses o años.

Bajo las actuaciones ordenadas por el fiscal del Estado de Vicenza, Paolo Pecori, varios miembros de la policia postal de Bolonia secuestraron fisicamente el servidor en los locales de DS logic srl, un ISP local.

De acuerdo con la orden, es una medida "preventiva" por un delito de"difamacion prolongada" contra la agencia de viajes de Milan, Turban Italia Srl. La operación se produjo tras la publicación de un mensaje por parte de un colectivo de Vicenza en el site de la ECN con el titulo de: "Solidaridad con el pueblo Kurdo - Boikot al Turismo en Turkia." El mensaje fue originalmente enviado a la mailing list de los centros sociales (cslist@ecn.org) -que recopila mensajes sobre las actividades de los Centro Sociales- y fue volcado automaticamente por una aplicacion a una página web. El mensaje era una reproducción de un panfleto distribuido publicamente y emitido por varias radios locales.

Como parte de la campaña de solidaridad con los kurdos, perseguidos por el gobierno turco, emprendida por varias asociaciones culturales y politicas italianas, el documento llamaba al boikot al turismo en turquia y particularmente al de los servicios de Turban Italia. Entre otras cosas el panfleto denunciaba que la agencia de viajes tiene lazos estrechos con el primer ministro turco Tansu Ciller, "organanizador de los escuadrones de la muerte que actuan contra el pueblo Kurdo y otros oponentes politicos"

Despues de la aparicion del mensaje en la web, los abogados de la agencia Turban Italia alertaron a las autoridades locales, pero a la vez se pusieron en contacto con los responsables de la ECN para intentar llegar a un acuerdo "amistoso". Se barajó como solución, el mantener el mensaje "difamante" si a la vez se incluia uno de réplica de la agencia de viajes. No estan claros los motivos que llevaron al fiscal del Estado a ordenar una accion tan repentina e indiscriminada como la que se llevó a cabo el sábado por la mañana.

Apesar de que la orden de secuestro no acusa a ninguna persona (todavía) Esta claro que el fiscal hace responsable a "Isole nella Rete (INR)" de el material contenido en su servidor. Bajo estas circunstancias, el debate sobre la responsabilidad de los servidores está muy extendido, más allá de una solución viable. No obstante, y como la Corte Suprema de los USA confirmó la semana pasada en un caso que involucraba a America Online (AOL), el sentir general es que los ISP no se deben hacer responsables del material icluido en sus sistemas.

En este caso, la operación es excesivamente perniciosa y seria, ya que golpea a un servicio que utilizan cientos de personas y asociaciones políticas y sociales en Italia y fuera de ella. Estas no estaban (y muchas siguen no estando) al tanto de los sucesos que han llevado al cierre de su servidor. Su derecho a comunicarse y expresarse libremente a sido violado sin niguna explicación ni notificación. Especialmente dañino les resulta a aquell@s que utilizan su cuenta de correo de la ecn para su trabajo diario.

En años recientes, las actividades de la ECN han ayudado enormemete a construir una fuerte red de solidaridad formada entre otras por la Lila (AIDS fighting association), Italy-Cuba Association, Telefono Viola (psychiatric abuse hot-line), ADL (sindicato), la CNT española. La ECN tambien daba hosting a organizaciones culturales: web-zines (.Zip , Necron, London's Freedom Press), grupos musicales (99 Posse, Sunscape, Electra) , radios libres (Radio Black Out, Radio Sherwood, Radio Onda d'Urto). Muy activas eran las listas de correo incluyendo una de solidaridad con Chiapas otra de "cyber-rights" (la única lista en italiano dedicada a la discusión pública sobre privacidad y encriptación.

La lista <<cyber-rights@ecn.org> y sus suscriptres/as fueron parte esencial en el éxito del Hackit98, el primer encuetro organizado por la comidad hacker italiana, que tuvo lugar en florencia (NT: y a la que el Nodo50 asistió) durante el primer fin de semana de junio y en el que participaron creca de mil personas.

Por el momento l@s miembros de INR-ecn.org estan reflexionado sobre la situción con el fin de encontrar la mejor solución a un problema que parece muy serio y cuyas repercusiones seran grandes y duraderas en el tiempo. La organización esta ahora trabajando en hacer llegar las noticias a tod@s sus miembros y usuari@s, así como a las agencias de información de todo el mundo y a la comuindad de internet. Un "mirror" del site estará en funcionamiento lo antes posible, mientras que se llevan a cabo el resto de iniciativas
